xVirals Referral Program Terms
These Terms set out the public promise by the operator of xVirals to give a reward to people who refer new users to xVirals when a specific result occurs, and the conditions of that promise (the "Referral Program" or "Program"). Joining the Program is entirely voluntary and places no obligation on participants to work, promote, sell or meet any target; a reward arises only when the result defined in section 1 (a Qualifying Payment by a Referred User) occurs.
To receive rewards you must accept these Terms electronically in the Dashboard. Upon acceptance, these Terms become binding between you and the Operator as regards the accrual, holding, payment and reversal of rewards. Rewards arising from Qualifying Payments made before you accept are held until acceptance and then enter the normal process. Please read the Terms in full before accepting and email info@xvirals.com with any question.
Key points (not a substitute for the Terms):
- The reward rate is tiered by your number of paying referrals: it starts at 30% and rises to 40% (section 3). It continues with no time limit for as long as your referral keeps paying.
- A reward accrues only if you also hold an active paid xVirals subscription at the moment the Referred User pays (section 2.2).
- Each reward is held for 30 days (refund and dispute window).
- Cash payouts are not open yet. Your earnings accumulate in your account; cash payouts will open once the business structure is complete. There is no date yet; the opening will be announced in the Dashboard and by email. Once payouts open, your accrued payable balance is paid under these Terms (section 6).
- Any change to your detriment, including a rate reduction, is notified 30 days in advance and requires your acceptance; if you do not accept, you may leave and keep your accrued balance (section 4).
- Your account may be suspended for suspicious activity for up to 60 days (section 11).
1. Parties, Nature of the Program and Definitions
Operator: Furkan Batuhan Kayahan (sole proprietor), who operates the xVirals service — referred to in these Terms as "xVirals" or the "Operator". Contact: info@xvirals.com · xvirals.com.
Nature of the Program: the Program is a public promise of reward made by the Operator by announcement within the meaning of article 8 of the Turkish Code of Obligations no. 6098: the Operator promises the reward in these Terms for the result of a Referred User making a Qualifying Payment. Participants are not asked to perform any work, provide any service or carry out any activity in return; whether to recommend xVirals to others is entirely the Participant's own choice.
- Participant: the natural or legal person holding a xVirals account who joins the Program by accepting these Terms in the Dashboard.
- Referred User: a new user who signs up to xVirals for the first time through the Participant's referral link or code and meets the attribution conditions in section 5.
- Qualifying Payment: each payment by a Referred User on xVirals confirmed as successful by the payment provider — including the first subscription payment, subscription renewals and credit pack purchases — provided it meets the conditions in sections 2.2, 3 and 7.
- Paying Referral: a Referred User who has made at least one successful Qualifying Payment (tier count, section 3.2).
- Referral Reward ("Reward"): the amount calculated by applying the rate to a Qualifying Payment, which becomes payable under the conditions in section 6. It may also be shown in the Dashboard as "earnings" or "commission"; the label does not change its nature.
- Net Amount: the amount actually received by the Operator from a Qualifying Payment after deducting taxes (VAT and similar indirect taxes), refunds, chargeback and dispute amounts, payment provider and merchant-of-record fees, and any discounts or coupons applied. Rewards are, as a rule, calculated on the Net Amount. The Operator may choose to calculate them on a higher amount (e.g. the payment amount excluding taxes); this is a practice in the Participant's favour, does not create an acquired right or course of dealing, and the Operator may return to the Net Amount basis under section 4.
- Dashboard: the referral screen in the Participant's xVirals account and the pages where Program announcements are published (the "Program Page").
- Payment Provider: Dodo Payments. Dodo Payments is the Merchant of Record for sales to xVirals customers. Rewards are paid directly by the Operator, not by Dodo Payments; Dodo Payments is not a party to these Terms and has no obligation towards the Participant.
2. Eligibility
2.1 General requirements
- Be at least 18 years old and have full legal capacity.
- Hold a valid xVirals account opened with accurate information and used in line with the Terms of Use. The Terms of Use form an integral part of these Terms.
- Accept the current version of these Terms electronically in the Dashboard. The date, version and the rate/tier table at the time of each acceptance are recorded permanently. Rewards accruing before acceptance are not forfeited; they are held until acceptance and then enter the process in section 6.
2.2 Active paid subscription requirement
A Reward accrues only if the Participant holds an active paid xVirals subscription at the moment the Referred User's Qualifying Payment is made. A free plan, trial credits, or a subscription that is cancelled, expired, unpaid or paused does not count as an "active paid subscription". No Reward ever accrues for Qualifying Payments made while the Participant's subscription is not active; even if the Participant subscribes again later, no retroactive Reward may be claimed for those payments. Such payments may be shown in the Dashboard as "ineligible" for transparency. The subscription requirement applies only to the accrual of Rewards. A Participant who remains in the Program also needs an active paid subscription to request a payout; however, the accrued balance of a Participant who leaves the Program, is removed without breach, or exits because the Program ends is paid without any subscription requirement under section 11.4.
2.3 Refusal
The Operator reserves the right to refuse participation in the Program without giving reasons, or to narrow eligibility for specific persons or channels. The technical availability of a referral link does not mean you have been accepted into the Program. This right may not be used to cancel Rewards that have already accrued.
3. Referral Reward and Tiers
3.1 Tier table
The Reward rate depends on the Participant's number of Paying Referrals. The tier table on the publication date of these Terms is:
- 1-4 Paying Referrals → 30%
- 5-9 Paying Referrals → 35%
- 10+ Paying Referrals → 40%
The binding table is the current tier table shown in the Dashboard and accepted by the Participant at the time of the Qualifying Payment. Changes to the table in the Participant's favour (a rate increase, a new top tier, a lower threshold) need no acceptance; changes to the Participant's detriment are possible only under section 4.
3.2 Counting tiers
- Paying Referrals are counted cumulatively over the life of the Program; a Referred User later cancelling their subscription does not reduce the count. However, Referred Users whose payments are all refunded or charged back, or who were obtained in breach of section 9, may be excluded from the count.
- The rate is determined by the count at the time the Qualifying Payment is recorded. When a higher tier is reached, the new rate applies to all Qualifying Payments recorded from then on (including payments by new and earlier Referred Users); Rewards already recorded are not recalculated.
- The Operator may set an individual rate for a specific Participant in writing (Dashboard or email); while it is in place, the individual rate replaces the tier table. Reducing an individual rate, or removing it so that a rate less favourable to the Participant applies, is possible only under section 4.
3.3 Calculation
- A Reward accrues separately for each Qualifying Payment (including renewals and credit pack purchases) for as long as the Referred User keeps paying and the Participant's active paid subscription continues. There is no time limit, but sections 4 and 16 apply if the Program is changed or ended.
- Each Reward record stores the rate applied at the moment it accrued. A later change to the rate or tiers does not alter Rewards that have already accrued.
- Rewards are calculated and recorded in US dollars (USD). The Reward base is the USD amount of the Qualifying Payment excluding taxes (VAT and similar indirect taxes); if the payment is made in another currency, the USD equivalent (settlement) reported to the Operator by the Payment Provider applies. The Reward on a payment whose USD equivalent cannot be determined is held until it is determined. Amounts are rounded to the nearest cent.
- Monthly cap: Rewards are started for at most 10 Referred Users per calendar month (UTC); a Referred User's Rewards start in the month in which their first Qualifying Payment is taken into the cap. If the cap is full that month, no Reward accrues for that Referred User's payments in that month and none may be claimed later for those payments; the referral relationship remains recorded, and Rewards for that Referred User start with their first Qualifying Payment in a later month in which the cap is available. The cap applies only where the Operator's records establish that it is full; where this cannot be established, the Reward is held. The Operator may raise the cap in the Participant's favour.
- Rewards belong to the Participant personally and may not be assigned.
4. Changes to the Terms and Revocation of the Promise
- Material changes to the Participant's detriment — in the tier table, any reduction of the rate for any number of Paying Referrals (lowering a tier rate, raising a threshold or removing a tier), reducing an individual rate, extending the holding period, raising the minimum payout, lowering the monthly cap and any other change to these Terms to the Participant's detriment — are notified to the Participant's registered email address and in the Dashboard at least 30 days before they take effect.
- A detrimental change becomes binding on the Participant only once the Participant expressly accepts the new terms in the Dashboard. Silence, continuing to share the referral link or remaining in the Program does not count as acceptance. Rewards arising from Qualifying Payments made after the effective date are held until the Participant accepts the new terms and then enter the process in section 6 under the new terms. A change does not affect Rewards accrued up to that point (no retroactive effect).
- A Participant who does not accept a change may leave the Program at any time; their accrued balance is preserved and paid under section 11.4. For a Participant who has not accepted by the effective date, the change notice also counts as notice of removal without breach under section 11.4; that Participant's participation ends on the effective date, no Reward accrues for Qualifying Payments after it, and the balance accrued up to it is paid under section 11.4.
- Changes in the Participant's favour (a rate increase, a new top tier, a shorter holding period, a lower minimum, opening cash payouts, a new payout method, etc.) apply from publication without acceptance.
- Measures taken in cases of fraud, abuse, requirements of law or payment provider rules, or breach of these Terms (sections 9-11) take effect immediately.
- Revocation: under article 8/2 of the Turkish Code of Obligations, the Operator may revoke the promise of reward — by ending the Program or changing its terms — only with effect for the future. Revocation does not cancel Rewards that accrued from Qualifying Payments made before it takes effect; those Rewards are preserved and paid under these Terms. Statutory rights under article 8/2 of the Turkish Code of Obligations are reserved.
5. Attribution Rules
- Clicking a referral link stores a cookie valid for 30 days in the browser. A new signup from the same browser within that period is attributed to the Participant. If several referral links were clicked, the last one clicked applies.
- A referral code must be entered no later than 72 hours after the Referred User's account is created; after that, no referral relationship can be established.
- Only users signing up to xVirals for the first time can be Referred Users. Existing users or users who previously had an account, additional accounts of the same person, and the Participant themselves cannot be Referred Users.
- The risk that attribution fails because cookies are deleted or blocked, a different device/browser is used, ad blockers or private windows are used, or similar reasons, lies with the Participant. The Operator is not responsible for lost attributions.
- The Operator's system records (database, payment provider event records and logs) are decisive as to whom a signup is attributed, whether a Reward has accrued and its amount. The parties agree that these records constitute conclusive evidence under article 193 of the Turkish Code of Civil Procedure no. 6100; the Participant reserves the right to bring counter-evidence.
6. Holding Period, Balance and Cash Payouts
6.1 Holding period
Each Reward is held for 30 days from the date it accrues (refund and dispute window). Once the holding period ends, the Reward moves to the payable balance. Rewards still in the holding period, suspended or under review are not included in the payable balance.
6.2 Cash payouts are not open yet
As of the publication date of these Terms, cash payouts are not open. Your earnings accumulate in your account; cash payouts will open once the Operator's business structure is complete. No opening date has been set and these Terms do not promise one; the Operator sets the opening date and announces it in the Dashboard and to your registered email address. For as long as cash payouts are closed:
- Rewards continue to accrue, holding periods continue to run and Rewards past their holding period move to the payable balance;
- section 7 on refunds, chargebacks and disputes applies unchanged;
- no payout requests are accepted and no payout method details (IBAN, PayPal, Wise, etc.) are collected;
- the payable balance does not lapse with time, even if the Participant leaves or is removed without breach: the small-balance claim period in section 11.4 and the dormancy period in section 11.5 only start to run from the date cash payouts open.
When cash payouts open, the accrued payable balance is paid under these Terms. Opening payouts is a change in the Participant's favour and applies from publication under section 4.
6.3 After cash payouts open
- When the payable balance is at least $50 (USD), the Participant may request a payout in the Dashboard. Payouts are not automatic; they are made by the Operator on request.
- Payout methods are announced in the Dashboard at opening; the planned methods are PayPal, bank transfer (IBAN) and Wise. Changes to the list of methods to the Participant's detriment are subject to section 4.
- Payouts are made, where possible, within 30 days of a complete request and delivery of the documents required under section 8. The currency is USD; exchange differences, currency conversion, intermediary bank, PayPal/Wise and transfer fees are borne by the Participant and may be deducted from the amount paid.
- The Operator is not responsible for delays, losses or payments to the wrong account caused by incorrect or incomplete payout details (account name, IBAN, email, etc.) provided by the Participant. The name on the payout account must match the identity on the xVirals account; otherwise the payout may be held.
- A Participant who remains in the Program also needs, to request a payout: an active paid subscription (section 2.2), acceptance of the current version of these Terms, and an account that is not suspended. For a Participant exiting without breach (sections 11.4 and 16), neither a subscription nor acceptance of a new version is required to request a payout.
6.4 Option to convert to credits
Before or after cash payouts open, the Operator may offer the option to convert all or part of the payable balance into xVirals credits. Conversion happens only on the Participant's express request in the Dashboard; the conversion rate is shown in the Dashboard before the request. The Participant is not required to convert; the balance of a Participant who does not convert is preserved under section 6.2. The converted amount is deducted from the cash balance and cannot be converted back to cash.
6.5 Program ending, service shutdown or transfer before payouts open
- If the Program is ended before cash payouts open (section 16), Rewards accrued up to the end date are preserved and paid under these Terms when cash payouts open.
- If the Operator permanently shuts down the xVirals service, cash payouts are deemed open for Participants with an accrued payable balance as of the shutdown notice, and those balances are paid under the procedure in section 6.3; in that case the credit conversion option does not replace a cash payout.
- If the xVirals service is transferred to a third party or to a company the Operator incorporates (section 17), the accrued balances are assumed by the transferee under these Terms.
7. Refunds, Chargebacks and Disputes
- If a Qualifying Payment is fully or partly refunded, charged back, or a payment dispute is decided in favour of the Referred User/cardholder, the related Reward is reversed in proportion to the refund. Reversal is made by recording a negative entry on the balance or cancelling the related Reward.
- When a dispute is opened on a payment, the related Reward is suspended until the dispute is resolved; if it is resolved in the Operator's favour, it returns to holding/the payable balance.
- If a reversed Reward has already been paid or converted to credits, the amount is set off against the Participant's later Rewards; if set-off is not possible or the Participant has left the Program, the Operator may request repayment of the amount paid in cash and the Participant shall repay it within 30 days of the request. The balance may therefore become negative.
8. Tax and Documents
- Calling the Program a "referral" or "reward" program does not change the tax nature of the Reward. A Reward paid in cash may constitute taxable income for the Participant under the applicable law. All tax, filing, social security and similar obligations arising from Rewards are the Participant's.
- Once cash payouts open, the Operator may, before paying, request an invoice, a self-employment receipt, an expense voucher (gider pusulası) or another document required by law; a tax identification number; identity verification (KYC) documents; and proof that the payout account belongs to the Participant. Payouts are held until the requested documents are provided.
- Reward amounts shown in the Dashboard are gross amounts INCLUDING VAT and all similar taxes. Any taxes (including VAT) on the invoice or receipt the Participant must issue are carved out of that amount; the Operator does not pay any tax on top of it.
- Taxes and withholdings the Operator is legally required to bear (including VAT reported by the Operator as the responsible party and income tax withholding) are deducted from the amount payable; the net amount paid to the Participant is reduced accordingly.
9. Prohibited Conduct
The following conduct is strictly prohibited (the list is not exhaustive):
- Self-referral; opening multiple accounts; creating fake or collusive referrals through accounts of the same household, family members, colleagues or persons controlled by the Participant.
- Payments made with, or facilitated through, fake, stolen or unauthorised payment instruments.
- Incentivised signups: promising or providing money, gifts, a share of Rewards or any other benefit to a Referred User in return for signing up (except the Operator's official campaigns).
- Publishing the referral link on cashback, coupon, discount or reward sites and similar incentive platforms.
- Spam: unsolicited bulk email, DMs, comment/reply spam, tag spam; promoting through automation, bots or bulk accounts on X or any other platform.
- Paid search advertising on the brand name: using "xVirals", "x virals", "xvirals.com" and all spelling variants, or confusingly similar terms, as keywords, bids, ad headlines or display URLs on search engines, social networks or ad networks.
- Domain name or social media impersonation (including typosquatting); creating names, profiles or content that give the impression of being an official xVirals account, employee, representative or authorised reseller.
- Misleading promises and statements: guarantees of income, followers or engagement; untrue claims such as "official X/Twitter partner" or "X approved"; promising features, prices or discounts xVirals does not offer.
- Producing or buying fake reviews, fake testimonials or fake ratings.
- Cookie stuffing, forced redirects, hidden iframes, pop-unders/pop-ups setting referral cookies without the user's knowledge; generating clicks/signups with bots, scripts or automated traffic.
- Manipulating attribution rules with VPNs, proxies, device fingerprint spoofing or similar methods.
- Promoting xVirals alongside, or on channels featuring, adult, hateful, violence-glorifying, illegal, copyright-infringing or misleading content.
- Promoting in ways that breach the terms of use, advertising or spam rules of X, Reddit or other platforms.
- Attempting to access Referred Users' accounts, act on their behalf or collect personal data from them.
10. Advertising Disclosure Obligation
- A Participant recommending xVirals with a referral link must disclose, clearly and at the same time as the recommendation, that they may receive a Reward for it. This obligation applies regardless of the Program being a reward program.
- For posts in Türkiye, disclosures such as "#reklam" or "#işbirliği" are used in line with the Guide on Commercial Advertising and Unfair Commercial Practices by Social Media Influencers of the Advertising Board of the Turkish Ministry of Trade. For audiences abroad, the US Federal Trade Commission (FTC) Endorsement Guides and similar rules of the target country apply.
- If an administrative fine, complaint or claim is directed at the Operator because of a breach of this obligation, the Operator has recourse against the Participant for the amounts paid and reasonable defence costs.
11. Suspicious Activity, Suspension, Removal and Leaving
11.1 Suspension
Where there is a concrete suspicion — such as suspicious activity, a possible breach of these Terms, a risk notice from the payment provider or an unusual refund/dispute rate — the Operator may suspend the Participant's Program account without prior notice. The suspension is notified to the Participant in the Dashboard and by email; to protect the confidentiality of the review, detailed reasons may not be disclosed until the review is concluded. During the suspension, new Rewards are recorded but held and not added to the payable balance; payout requests cannot be made. The Operator may request explanations and documents from the Participant as part of the review.
The review is concluded within 60 days of the suspension at the latest. This period is extended by the time taken by the Participant to deliver explanations or documents requested by the Operator. If no breach is established when the period ends, the suspension is lifted and the held Rewards return to the normal process.
11.2 Outcome of the review
- If no breach is established, the suspension is lifted and Rewards held because of it automatically return to the normal process (to the payable balance if their holding period has ended).
- A Reward accrues only for a result achieved in compliance with these Terms. If a serious breach is established, the Participant's entire unpaid balance is forfeited as a contractual penalty. Serious breaches are: self-referral or collusive/fake referrals; use of, or facilitating the use of, fake, stolen or unauthorised payment instruments; cookie stuffing, forced redirects, or generating clicks/signups with bots or automated traffic; manipulating attribution with VPNs, proxies or device fingerprint spoofing; paid search advertising on the brand name; impersonating xVirals or its official representatives.
- For other breaches, only unpaid Rewards related to the breach (those attributable to Referred Users who came through the infringing post or channel) are forfeited; accrued balance unrelated to the breach is preserved.
- In both cases, repayment of Rewards related to the breach that have already been paid may be requested and set off against later payouts; the Operator's right to claim damages exceeding the penalty, upon proof, is reserved. The Operator may also remove the Participant under section 11.3 and, depending on the seriousness of the breach, take action against the xVirals account under the Terms of Use.
11.3 Removal for breach
In the event of a breach of these Terms, in particular sections 9 and 10, the Operator may remove the Participant from the Program immediately by notice. Section 11.2 applies to the unpaid balance: in a serious breach the entire balance, and in other breaches only the amount related to the breach, is forfeited; the remaining accrued balance is paid under section 11.4.
11.4 Leaving and removal without breach
- The Participant may leave the Program at any time by email or using the tool provided for this in the Dashboard. Leaving during a suspension does not affect the outcome of the review or section 11.2.
- The Operator may remove the Participant from the Program without breach on 30 days' notice.
- In these cases, Rewards accrued up to the exit date are paid after their holding period ends: a balance above the minimum payout ($50) is paid on request; a balance below it is paid without the minimum if claimed within 90 days of the exit date or of the date cash payouts open, whichever is later, and lapses if not claimed within that period. If cash payouts are not open yet, payment awaits their opening under section 6.2. No Reward accrues for Qualifying Payments made after the exit.
11.5 Dormant accounts
If, after cash payouts open, no new Reward accrues and no payout is requested on the Program account for 12 months, then — provided the balance is below the minimum payout — a balance not claimed within 30 days of the Operator's email notice lapses. Time during which cash payouts are closed is not counted.
12. Use of the Brand
- The Operator grants the Participant a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the xVirals name and materials provided by the Operator solely when sharing their referral link.
- Logos and brand elements may not be altered, distorted or combined with other brands.
- Without the Operator's written consent, the xVirals name or a similar term may not be used in a domain name, subdomain, social media handle, app name or company/trade name.
- When participation ends, the Participant immediately stops using the brand.
13. Independence; No Agency or Representation
The Program does not create any employment, work-contract, mandate, representation, agency, dealership, distribution, franchise, company or partnership relationship between the parties. The Participant may not make statements, give undertakings, enter into contracts or collect payments on the Operator's behalf.
- No obligation to act: the Participant has no obligation to post, find customers or meet sales targets within a given period, in a given number or on an ongoing basis; they alone decide whether, when and how much to recommend xVirals. A Participant who makes no referrals faces no sanction.
- No exclusivity: the Participant is granted no exclusivity by territory, customer group or channel; the Operator may run the Program with any number of participants and sell directly at the same time. The Participant is likewise free to recommend other products.
- The customer relationship belongs to the Operator: Referred Users are customers of the Operator (and, as regards sales, of the Payment Provider) from the outset. The Participant has no portfolio, clientele or data rights over Referred Users.
- The parties declare that the Participant is not an agent within the meaning of the Turkish Commercial Code no. 6102 and that the agency provisions (articles 102 et seq. of the Turkish Commercial Code) are not intended to apply to the Program.
14. Confidentiality and Personal Data
- The Participant has no access to Referred Users' personal data. The Dashboard shows only anonymised or aggregate information (e.g. number of referrals, number of paying referrals, Reward amounts).
- The Participant's own personal data is processed under the Privacy Policy and the "Referral Program" section of the Data Protection Notice. While cash payouts are closed, no payout method details (IBAN, PayPal, Wise) or tax/identity documents are collected. Once payouts open, this data is processed only to make payouts, meet legal obligations and prevent abuse; it is transferred to PayPal, Wise and banks for payment (including transfers abroad) and kept for the retention periods required by law.
- Information the Operator communicates to a specific Participant about the Program (individual rate, review correspondence, etc.) is confidential and may not be shared with third parties.
15. Disclaimer, Limitation of Liability and Indemnity
- The Program is provided "as is". The Operator does not guarantee that the Program will be uninterrupted or error-free, or that any number of signups or any earnings will be achieved.
- The obligation to pay Reward balances that have accrued and become payable under these Terms is excluded from this limitation. Otherwise, the Operator's total liability arising from the Program is limited to the higher of the total Rewards actually paid to the Participant in the 12 months preceding the event giving rise to the claim and 100 USD. The Operator is not liable for indirect loss, loss of profit or loss of reputation. These limitations do not apply in cases of the Operator's intent or gross negligence under article 115 of the Turkish Code of Obligations no. 6098, or where mandatory law does not permit limitation.
- The Participant shall indemnify the Operator against claims, administrative fines, losses and costs, including reasonable attorney fees, arising from breaches of these Terms, of law or of third-party rights attributable to the Participant's fault, or from the Participant's own posts, and grants the Operator a right of recourse.
16. Changing or Ending the Program
The Operator may end the Program entirely or change its structure (section 4, revocation). Ending the Program is announced on the Program Page and/or notified by email at least 30 days in advance. Rewards accrued up to the end date are preserved and paid under sections 6 and 11.4 — if cash payouts are not open yet, on their opening under section 6.5. In compelling cases such as a change in law or a request from the payment provider or a public authority, the notice period may be shortened; the accrued balance is preserved in that case too.
17. General Provisions
- Notices: the Operator's notices are sent to the email address registered on the Participant's xVirals account or published in the Dashboard, and are deemed given on the day the email is sent or the notice is published. The Participant's notices are sent to info@xvirals.com. Keeping the email address up to date is the Participant's responsibility.
- Assignment: the Participant may not assign rights or obligations under the Program without the Operator's written consent. The Operator may assign the Program by notice to a third party taking over the xVirals service or to a company it incorporates; section 6.5 then applies.
- Severability: the invalidity of a provision does not affect the validity of the others; an invalid provision is deemed replaced by the valid provision closest to its purpose.
- Entire terms: these Terms, together with the Terms of Use and any individual terms notified in writing in the Dashboard, are the entire terms of the Program. Failure to exercise a right is not a waiver of it.
- Version: this text is version 2026-10-15. For Participants who accepted earlier versions, this version applies under section 4 upon the Participant's acceptance in the Dashboard (and, for provisions in the Participant's favour, from publication).
- Mandatory law: nothing in these Terms shall be construed as restricting rights the Participant has under mandatory law (including consumer law).
- Governing law and jurisdiction: these Terms are governed by the laws of the Republic of Türkiye. Where both parties are merchants, the Istanbul (Central/Çağlayan) Courts and Execution Offices have jurisdiction over disputes; otherwise the statutory rules on jurisdiction apply. In commercial disputes, applying to mediation before filing a lawsuit is a precondition under article 5/A of the Turkish Commercial Code no. 6102.
- Language: these Terms are published in Turkish and English. In the event of any conflict between the two texts, the Turkish text prevails.
